These Terms of Use govern the service relationship between us and store owners ("User") using the Bengal e-commerce infrastructure ("Platform") operated by Bengal. By registering on the Platform, you are deemed to have accepted these terms.
1. Definition of Service
The Platform is a software service (SaaS) that offers store owners the ability to set up e-commerce websites, product/order management, content management (CMS), blogging, payment integration, and related digital tools on a subscription model.
2. Account and Security
- You are responsible for providing accurate, current, and complete information during registration.
- You are responsible for the confidentiality of your account login information and for all activities conducted through your account.
- You must notify us immediately if you notice any unauthorized access.
3. Subscription, Pricing and Payment
- The service is offered on a monthly or annual subscription basis, according to your chosen plan.
- An invoice for the periodic subscription fee will be generated and made available in the "Subscriptions and Invoices" section of your panel.
- Payments are processed through a secure payment institution (Tosla) infrastructure; your card details are not stored by us.
- Your account may be suspended at the end of the trial period or if payment cannot be collected.
- Prices may be updated with prior notice.
4. User Content and Obligations
All content you add to your store (products, images, text, customer data) is your responsibility. As a User:
- to act in compliance with applicable legislation, KVKK (Personal Data Protection Law), and consumer rights,
- to not publish illegal, misleading, or content/products that infringe upon third-party rights,
- to prepare legal texts for your own customers (KVKK, distance sales, returns)
you agree and undertake.
5. Intellectual Property
The software, design, and brand of the Platform belong to Bengal. You are granted a right of use; copying, reproducing, or reverse engineering the source code is prohibited. However, the intellectual property of the content you upload to your store belongs to you.
6. Service Continuity
We exercise utmost care to provide uninterrupted service; however, temporary interruptions may occur due to maintenance, updates, or force majeure events. We announce planned maintenance as much in advance as possible.
7. Termination
- You can cancel your subscription at any time; refund of fees is subject to relevant legislation and plan conditions.
- We reserve the right to suspend or terminate your account in case of a breach of these terms.
- A reasonable period is granted for the export of your data upon account closure.
8. Limitation of Liability
The Platform is provided "as is". The User is responsible for the results arising from their store's sales, customer relations, and content. Our liability for indirect damages is limited to the extent permitted by applicable law.
